RULES OF THE
SOUTH COAST DISTRICT BOWLING ASSOCIATION INCORPORATED
PART I – PRELIMINARY
1. Interpretation
A In this Constitution unless the context or subject matter
otherwise indicates or requires:
"Association" means the South Coast District Bowling Association.
"Association Match" means any match arranged by the Royal New South
Wales Bowling Association, Zone 7, this association, or any Club in
its Major Singles, Pairs, Triples or Fours Championship.
"Affiliated Club" means a properly constituted body of 16 or more
members and having a green, ready for play, of not less than four
rinks laid down in conformity with the laws of the game and is
affiliated with the Royal New South Wales Bowling Association
(RNSWBA) and whose rules or constitution is, not inconsistent with
this Constitution.
"Affiliated Provisional Club" means a properly constituted body of
16 or more members, and, having acquired the necessary site,
contemplates the construction of a green of not less than four rinks
to be laid down in conformity with the laws of the game and is
affiliated with the Royal New South Wales Bowling Association
(RNSWBA) and whose rules or constitution is, not inconsistent with
this constitution.
"Management Committee" means Officers and delegates of affiliated
clubs as constituted by these Articles.
"Deputy" means a member appointed to act for a Delegate.
"Secretary" means Honorary Secretary or Acting Honorary Secretary
for the time being.
"Treasurer" means Honorary Treasurer or Acting Honorary Treasurer
for the time being.
"Full Member" in relation to an affiliated club means-
(a) A male member of that club, at any time, when his status as a
member of that club is relevant for the purpose of any provision of
this Constitution, is a financial member of that club by reason of
his having paid the full or Junior subscription for membership of
that club; or
(b) A male life member of that club.
"Junior member in relation to an affiliated club, means a male
member of the club, under the age of 18 years, being a financial
member of an affiliated Club.
In this Constitution, words in the singular include the plural and
vice versa.
B In these rules -
(a) a reference to a function includes a reference to a power,
authority and duty; and
(b) a reference to the exercise of a function includes, where the
function is a duty, a reference to the performance of the duty.
C The provisions of the Interpretation Act, 1987, apply to and in
respect of these rules in the same manner as those provisions would
so apply if these rules were an instrument made under the Act.
PART II – COMPOSITION
2. Composition
The South Coast District Bowling Association shall consist of
affiliated clubs namely:-

PART III - STATEMENT OF OBJECTS
3. Objects
The objects of the Association shall be:-
(a) Affiliate with the Zone and State body
(b) To arrange and conduct, in conjunction with the Royal New South
Wales Bowling Association, the affairs of the Association for which
it is a District Association
(c) To promote the welfare of the Clubs affiliated with it
(d) To conduct bowls events
(e) To join with any other body, or the public generally, in
promoting the welfare of residents of the District for which it is
the District Association
PART IV – MEMBERSHIP
4. Club Membership
A For the purpose of these Rules, a Member shall be deemed only to
be a Member of the Club having registered his membership and paid
his subscription in terms of Rule 7(a) but if two or more Clubs
shall have each registered and paid the subscription on behalf of
the same Member in any season then such Member shall be deemed to
have declared to play for the Club with which he shall have first
played in any Association Competition during the season. All Major
Club Championships are deemed to be Association Competitions.
B If a member is registered with the Royal New South Wales Bowling
Association by two of more Clubs in the South Coast District Bowling
Association, that is a multiple member;
Such member shall only have his capitation fee paid to the District
by that Club that he plays for as his "home Club" in order to play
Major Club Championships and Association Competition.
5. Qualification for Affiliation
A. A Club
(1) of which there are at least sixteen (16) financial members;
(2) which has ready to play at least one green
(a) of which the Club is owner or has some other secure tenure
approved by the Association, and of which the Club either has
control and management or has some agreement or arrangement with the
person or body having control and management which agreement or
arrangement is approved by the Association;
and
(b) which has at least four (4) rinks laid down in conformity with
the laws of the
game of bowls
(3) whose rules are, or Constitution is, not inconsistent with this
Constitution is entitled, subject to this Constitution, to be
granted affiliation
B. A Club
(1) of which there are at least sixteen (16) financial members
(2) which has given an undertaking to the Association in a form
approved by the Association that it will lay down, within twelve
(12) months after the date of its application for affiliation, at
least (1) green
(a) on land which it is the owner or has some other secure tenure
approved by the Association, or of which it has entered into
negotiations to become the owner or to obtain such a tenure; and
(b) which will have at least four (4) rinks laid down in conformity
with the laws of the game of bowls
(3) which has not previously been granted provisional affiliation;
(4) whose rules are, or Constitution is, not inconsistent with this
Constitution is entitled, subject to this Constitution, to be
granted provisional affiliation with the Association
C. Register of Members
(1) The public officer of the association shall establish and
maintain a register of members of the association specifying the
name and address of each person who is a member of the association
together with the date on which the, person became a member.
(2) The register of members shall be kept at the principal place of
administration of the association and shall be open for inspection,
free of charge, by any member of the association at any reasonable
hour.
6. Club Application
Any Club applying for affiliation shall support its application by a
copy of its rules and any necessary documents, that it possesses the
necessary qualifications as set forth in these rules. Similar
documents shall be furnished whenever required by the Association
7. Annual Subscriptions
(a) Every affiliated Club shall pay to the Association an annual
capitation fee (annual subscription fee) for each of its full
members. The amount of such capitation fee (annual subscription fee)
shall be determined at the Annual General Meeting each year, as
provided for in the Articles of the Royal New South Wales Bowling
Association. For the purpose of these Rules a member shall be deemed
to be a member of the Club having registered his membership and paid
his subscription. The Club responsible in each case will be the Club
for which the member has declared to play as provided in Rule 4(a)
(b) The Secretary of each affiliated Club shall furnish to the
Secretary of the Association not later than the 21st August in each
year, a list in alphabetical order, of the names of all Full, Life
and Junior members. Only such members or additional members notified
shall be eligible to compete in Association competitions with such
Club. Provided that the Secretary of every affiliated Club shall
immediately register with the Secretary of the Association the full
names and addresses of any such additional members accepted for
membership at any subsequent date during the season.
(c) The annual subscription shall be due on the first day of July in
each year, and must be paid to the Association no later than the 1st
September in each year. Such payment shall make the paying Club
financial for the year ending 30th June following, and will entitle
their representatives or delegates, as the case may be, to speak and
or vote at any meeting of the Association or Management Committee
until 30th September next following.
(d) Every Provisional Club of which at least 16 members have paid
the annual subscription for the then current year shall be entitled
to apply for conditional affiliation with the Association. The
application may be granted if the Provisional Club undertakes
completion of the laying down of the green within twelve months from
the date of such application. When the green shall have been laid
down in conformity with the Laws of the Game and is ready for play,
the provisional affiliation, on application of the Provisional Club,
may, by resolution of the Association, be confirmed and the Club
granted affiliation. If the green shall not be laid down within the
said period of twelve months the Association may by resolution
forthwith revoke the provisional affiliation of any such Club and no
further application shall be granted until the green has been laid
down in accordance herewith. Two (2) delegates may be sent to any
meeting of the Association by each Provisional Club but such
delegates shall take no part in the deliberations at any meeting and
shall not be entitled to stand for any Office in the Association.
(e) The annual subscription for Junior Members shall be fifty
percent (50%) of the annual subscription of a full member.
8. Life Membership
The Association at the Annual Meeting may appoint Life Members of
the Association, provided that the person(s) nominated shall over a
period of a minimum of ten (10) years rendered long and meritorious
service to the Association and provided that no member shall be
granted Life Membership unless nomination is made by two (2)
Officers or delegates in writing at least twenty-one (21) days prior
to the date of such Annual Meeting and the subsequent adoption of
the nomination by not less than two-thirds of those present and
entitled to vote.
9. Members Liabilities
The liability of a member of the association to contribute towards
the payment of the debts and liabilities of the association or the
cost, charges and expenses of the winding up of the association is
limited to the amount, if any, unpaid by the member in respect of
membership of the association as required by Rule 7.
10. Disciplining of Members
If any member shall wilfully refuse or neglect to comply with the
provisions of the rules of the association or shall be guilty of any
conduct of which in the opinion of the Committee is unbecoming of a
member or prejudicial to the interest of the association the
Committee shall have power to reprimand and fine and suspend and
expel such member from the association. Provided that at least seven
(7) days before the meeting of the committee at which a resolution
to reprimand and/or fine and/or suspend and/or expel such member or
any combination thereof is put the member shall have had notice in
writing of such meeting and of what is alleged against him and that
he shall at such meeting and before the passing of such resolution
have had an opportunity of giving orally or in writing any
explanation or defence he may think fit and provided further that no
member shall be expelled from the association unless the resolution
for his expulsion is passed by a majority of two-thirds of those
committee members present and voting.
11. Right of Appeal of Disciplined Member
(1) A member may appeal to the association in general meeting
against a resolution of the committee which is passed under rule 10,
within 7 days after notice of the resolution is served on the
member, by lodging with the secretary a notice to that effect.
(2) Upon receipt of a notice from a member under clause (1) the
secretary shall notify the committee which shall convene a general
meeting of the association to be held .within 21 days after the date
on which the secretary received the notice.
(3) At a general meeting of the association convened under clause
(2):-
(a) no business other than the question of the appeal shall be
transacted;
(b) the committee and the member shall be given the opportunity to
state their respective cases orally or in writing, or both; and
(c) the members present shall vote on the question of whether the
resolution should be confirmed, revoked or varied.
(d) voting shall be conducted on a show of hands unless the meeting
resolved by ordinary majority a secret ballot
12. Resolution of Internal Disputes
Disputes between members in their capacity as members of the
association shall be referred to the committee of the association
for resolution.
Disputes between members of the association and the association
shall be referred to the Royal New South Wales Bowling Association
for determination.
PART V - MANAGEMENT COMMITTEE
13. Meetings of the Management and Executive Committees
(a) The Management Committee shall meet for general meetings in the
odd months of the year, that is, January, March, May, July,
September, November, such time, date and place to be decided by the
Management Committee. Special General Meetings may be called by the
President, or by the Secretary on a written request signed by
representatives of not less than five (5) affiliated Clubs.
(b) The Executive Committee shall meet when summoned by the
President, or by the Secretary on a written request signed by at
least four (4) of its members.
14. Notice of Management Committee Meetings
Notice of every meeting of the Management Committee and the nature
of the business to be transacted thereat shall be posted or
delivered to each Executive Officer and affiliated
Club at least fourteen (14) days before the date of an Ordinary
Meeting or Special Meeting. Notices of motion shall be delivered to
the Secretary at least twenty-one (21) days before
the date of an Ordinary Meeting or Special Meeting.
15. Quorum of Management Committee and Executive Meetings
At all meetings of the Management Committee, ten (10) Officers and
Delegates, and at all
meetings of the Executive four (4) members shall form a quorum.
Should a quorum not
be present within thirty (30) minutes of the appointed time, the
meeting shall lapse or may be adjourned to such date, time and place
as may be determined by those present.
16. Management
(a) The management of the Association shall be vested in a committee
consisting of Officers, Delegates and Chairmen of Permanent
Sub-Committees who shall be appointed as hereinafter provided
(b) The Officers shall be Patron, President, Immediate Past
President,(who shall have occupied the office of President for a
period of at least one full year whilst remaining a Member of an
affiliated Club) four (4) Vice-Presidents, Honorary
Secretary/Treasurer, Honorary Assistant, Secretary/Pennant Recorder,
Publicity Officer, and Chairmen of Permanent Subcommittees
(c) The abovementioned Officers, (with the exception of the
Immediate Past President) shall be elected at the Annual Meeting of
the Association and shall hold office until their successors have
been appointed.
(d) No person shall hold the office of President for a period of
more than three (3) consecutive years, not including any broken
period
(e) At all meetings of the Management Committee, the Executive and
Delegates shall be entitled to vote.
17. Officers and Duties
(a) The President shall preside at all meetings of the Association
Management and Executive Committees. Should the President be absent,
or being present decline to preside, the Vice-President first
elected shall preside, or failing him. The Vice-President next
elected and so on. Should all Vice-Presidents be absent, or being
present decline to preside, the Hon. Secretary shall call for
nominations from the Delegates present and shall elect a Chairman
there from. The President and Hon. Secretary shall be ex-officio
members on all subcommittees except Selection.
(b) The Treasurer shall receive and pay all moneys on account of the
Association. He shall keep a current account to be styled the "South
Coast District Bowling Association" at such financial institutions
as the Management shall direct, such account to be operated on by
cheque as directed by Rule 35(a) and shall furnish a statement of
receipts and disbursements as required, and a properly audited
account and financial statement to accompany the Annual Report.
(c) The Secretary shall keep a faithful record of business
transacted at all Management Committee, Executive Committee, Annual
and Special Meetings. He shall keep a register of all Officers and
Delegates. He shall call all meetings in accordance with these
rules, attend all meetings of the Association and see the minutes of
all proceedings are properly kept as a record. He shall keep records
and statistics as required and shall submit the Annual Report for
the season to the Annual Meeting. He shall also keep a record of all
Real and Personal property of the Association.
(d) The Assistant Secretary/Pennant Recorder shall assist the
secretary when required by that Officer. He shall act as Registrar
for Pennant Competitions and maintain official records of results in
such events. Any infringements of conditions governing eligibility
of players should be reported to the Match Committee for any
necessary action to be taken.
(e) Should the Secretary/Treasurer or Assistant Secretary/Pennant
Recorder be absent or ill, or should they neglect or refuse to abide
by these Rules, the Management Committee shall have the power to
appoint another to act in his stead.
18. Absence and Leave of Absence
(a) Upon being satisfied of the bona fides of the case and provided
no undue inconvenience may ensue, the Management Committee may grant
leave of absence to Officers of the Association, members of the
Executive Committee and members of Permanent Committees and
Sub-Committees
(b) The position of any Officer of the Association who shall absent
himself for three (3)
consecutive meetings of the Management Committee, without having
obtained
permission as above provided, may be declared vacant by the
Management Committee.
The provisions of this sub-clause shall not apply to the Patron.
19. Vacancies
(a) The Management Committee shall fill the vacancies occurring
amongst its Officers, or in any Sub-Committee, or in the position of
Auditor, with the exception of President, who shall be elected at a
Special Meeting of the Association. No such vacancy shall be filled
until fourteen (14) days' previous notice shall have been given to
those entitled to attend and vote at the meeting at which it is
intended to fill such vacancy.
(b) For the purpose of these rules a casual vacancy in the office of
a member of the committee occurs if the member-
(i) dies;
(ii) ceases to be a member of the association;
(iii) becomes an insolvent under administration within the meaning
of the Companies New South Wales) Code;
(iv) resigns office by notice in writing given to the secretary;
(v) is removed from office;
(vi) becomes of unsound mind or a person whose person or estate is
liable to be dealt within any way under the law relating to mental
health; or (vii) is absent without the consent of the committee from
three (3) consecutive committee meetings.
20. Delegates
Every fully affiliated Club shall be entitled to send two (2)
delegates to every Management Committee meeting of the Association.
Immediately after the appointment of Delegates the Club shall notify
in writing to the Association Secretary the names and postal
addresses of such Delegates. Should any Delegate fail to attend or
be represented by a Deputy (as provided in Rule 21) three meetings
consecutively, his scat shall automatically become vacant and his
Club shall be notified of the fact within seven (7) days. Such
delegates shall not be again appointed during that year. The
Delegate to the Royal New South Wales Bowling Association shall be
the President or his nominee. Delegates to Zone shall be the
President, Secretary and Chairman of the Match Committee or such
person(s) as the Management Committee shall nominate
21. Deputy Delegates
In the event of a Delegate being unable to attend any meeting of the
Management Committee he (or the Secretary of his Club) may in
writing appoint any member of his Club as his deputy at such
meeting.
22. Executive Committee
(a) The Executive Committee shall consist of the following:-The
President, the four (4) Vice-Presidents, the Hon.
Secretary/Treasurer, the Immediate Past President, the Honorary
Assistant Secretary/Pennant Recorder, Publicity Officer and the
Chairman of each of the permanent sub-committees.
(b) The Executive Committee shall, subject to these Rules, be
entrusted with the following
powers and duties:-
(i) It shall deal with all matters of urgency relating to finances
and have power to incur liability to an amount not exceeding
$1,000.00
(ii) It shall deal with any matters which in its opinion should be
dealt with without waiting for the Ordinary or Special Meeting of
the Management to be called, provided that at each meeting of the
Management Committee, the Secretary shall provide a written report
from the Executive of any business that it shall have transacted or
dealt with since the previous meeting.
23. Sub-Committees
(a) Permanent Sub-Committees shall be elected as hereinbefore
provided, except that no club shall have more than one of its
members on any one Permanent Sub-Committee, except the Coaching,
Umpires and Junior Sub-Committees, who if unable to find suitable
qualified candidate/s from other club/s are exempt from this
restriction. Every Sub-Committee shall report to each meeting of the
Management Committee the results of its labours, and shall hold
office until its successor is appointed.
(b) The Coaching Committee shall consist of a Chairman and three
members, all of whom shall be currently accredited National Coaches
appointed as the Management Committee sees fit. The duty of this
Committee shall be to conduct coaching examinations and such other
duties as the Management Committee shall direct.
(c) There shall be five Permanent Sub-Committees elected by the
Management Committee annually.
(i) The Match Committee, which shall consist of a Chairman and three
(3) members.
(ii) The Selection Committee, which shall consist of a Chairman and
four (4) members, two from the northernmost and two from the
southernmost half of the Clubs
(iii) The Greens Committee, which shall consist of six (6) members,
one the Chairman, three (3) from the northernmost half of Clubs and
three (3) from the southernmost Clubs.
(iv) The Umpires Committee, which shall consist of a Chairman and
three (3) members each of whom shall be National Umpires holding the
necessary qualifications.
(v) The Junior Bowls Committee, which shall consist of a Chairman
and two (2) members. The Chairman being the delegate to New South
Wales Junior Bowls Association.
(d) The duties of the Match Committee shall be as follows:-
(i) To arrange the necessary details for Pennant and Association
Competitions and matches and to present not later than the November
meeting of the Management Committee in each year the conditions for
the ensuing season in respect to such competitions, a copy of the
proposed conditions to be forwarded to all affiliated Clubs fourteen
(14) days prior to such meeting.
(ii) Subject to the conditions laid down in the Season's Programme
as provided and adopted by the Association and Clause (c) of this
Rule to have full control in the playing and conducting of all
Pennant and Association Competitions.
(iii) To settle all disputes arising in connection with Pennant and
other Association fixtures, subject to appeal to the Management
Committee.
(iv) To deal with all applications for permits in Association
Competition/s
(v) To represent the Association on matters in connection with the
testing of bowls.
(vi) It shall arrange all necessary details for Association matches.
After receiving from the Greens Committee a list of greens
recommended as suitable it shall allot the greens for Association
matches.
(vii) Generally , to deal with and report upon matters relevant to
such duties that may be referred to it by the Management Committee.
(viii) To give consideration to any report in writing by the Greens
Committee through the Secretary as to the green(s) of any Club
considered by the Committee to be unfit for the playing of any
Association Match.
(ix) The Match Committee has the right to grade all Clubs for
Pennant play.
The Match Committee may decline to accept entries from such Clubs
unless said Club:-
(aa) Can submit acceptable evidence that the green(s) will be placed
in a condition satisfactory to the Match Committee before the date
set down for the playing of the first round of the competition
concerned, or
(bb) Can make arrangements with another Club or Clubs in reasonably
close proximity for the use of sufficient green space satisfactory
to the Match Committee to serve as its home green(s) for the purpose
of the events upon all days on which a round of the competition is
set down for play until such time as its own green(s) is/are placed
in a condition satisfactory to the Match Committee, or
(cc) Is prepared to forfeit all matches set down for play on days
which its own green(s) is/are considered by the Match Committee
(after receipt of a report from the Greens Committee) to be unfit
for play and upon which days it is unable to obtain the use of
satisfactory green space from another Club in reasonable close
proximity.
(x) In the case of green(s) that become unfit for play during the
progress of an Association Competition and are reported as such by
the Greens Committee in writing to the Match Committee through the
Secretary (unless the Club concerned shall make arrangements
satisfactory to the Match Committee to play the matches at another
Club) such Club shall forfeit all matches until its green(s) have
been declared by the Greens Committee as being fit to play.
(e) The duties of the Selection Committee shall be:-
(i) To select sides to play in all Association Matches
(ii) To immediately report such selections to the Secretary
(iii) To arrange for representatives from their Committee to be in
attendance at quarter-finals, Semi-finals and finals of all
Association Competitions
and fixtures.
(f) The duties and powers of the Greens Committee shall be:-
(i) To inspect all greens in due time before the commencement of the
Pennant Competition and during the season and to report to the
Management Committee
upon their fitness for use in connection with Pennant and other
Association fixtures.
(ii) Prior to the selection of greens for the playing of
Inter-District and Inter-Association matches, to make an inspection
and furnish recommendations
in writing to the Match Committee as to the greens which, in its
opinion,
arc suitable to be used for such matches.
(iii) After inspection of any green to furnish to the Management
Committee
a report on the greens inspected, more particularly in relation to
compliance
with the By-Laws of Bowls Australia as to the area. banks, ditches,
rinks,
boundary pegs, etc.
(g) The duties of the Umpires Examination Committee shall be to
maintain (in conjunction with the Secretary) a register of holders
of National Umpires Certificates and date of expiry of such
certificates. To promote and encourage as far as practicable classes
for aspiring National Umpires, arrange examinations and
re-examinations as required, and to carry out such functions as the
Management Committee may from time to time decide.
(h) The Junior Bowls Committee shall promote the game by holding
competitions and seminars to encourage young bowlers to participate
in the game of bowls and carry out such functions as the Management
Committee may from time to time decide.
PART VI - MEETINGS
24. Notice of Annual Meeting
The Annual Meeting of the Association shall be called by giving at
least fourteen (14) days notice by circular to all affiliated clubs.
25. Annual and Special General Meetings
(a) The Annual Meeting of the Association shall be held in the month
of August in each year, and this meeting and every Special General
Meeting of the Association shall comprise the Executive Committee
and two (2) delegates appointed by each affiliated club, as
hereinafter provided.
(b) No delegate shall be permitted to speak or vote at any meeting
unless the annual Subscriptions payable by his club have been duly
paid in accordance with the provisions of rule.
(c) Should any delegate be unable to attend the Annual or any
Special Meeting, he (or the Secretary of his club) may, in writing,
appoint another member of such club to attend in his place, and vote
there at as his deputy.
(d) Nominations for the position of President, four
(4)Vice-Presidents (one only to be elected from any affiliated club
) Honorary Secretary/Treasurer, Assistant Honorary Secretary/Pennant
Recorder, Publicity Officer, may be held in conjunction with another
office) and all Sub-Committees (all of whom shall be Full members of
an affiliated club) and the position of Honorary Solicitor and
Auditor (who may be a qualified registered Public Accountant) shall
be made in writing by the proposer and seconder, with the consent in
writing of the nominee and delivered to the Secretary at least 21
days prior to the date of the Annual Meeting. Should such
nominations fall short of the required number, those nominated shall
be declared elected. Any vacancies shall be filled at the meeting by
being proposed in the ordinary manner, with the consent of the
nominee. Permanent Subcommittees may be elected at the first General
Meeting.
(e) The office of Patron shall not be elective but the appointment
may be made by the Association on the recommendation of the
Executive
(f) No person shall hold more than one office in the Association,
subject to 25(d) at any one time except as a member of any Permanent
Sub-Committee.
(g) Any business requiring a special resolution may be transacted at
the Annual Meeting if at least 28 days notice in writing has been
given to the Secretary, who shall notify all Club Secretaries at
least 21 days before the meeting of all business to be transacted
thereat.
(h) A preliminary notice of the Annual Meeting shall be issued by
the Secretary, setting forth the usual business and the fact that
nominations for the positions set out in rule 25(d), together with
notices of special business must be in the hands of the Secretary at
least 28 days prior to such Annual Meeting. Such preliminary notice
shall be issued no later than the first week in July.
(i) At all Annual or Special Meetings of the Association the
Executive and Delegates shall be entitled to vote, and all Officers
shall be eligible for re-election subject to nominations in terms of
rule 25(d).
26. Business at Annual Meetings
At the Annual Meeting the order of business shall be:-
(a) The roll of Officers and Delegates shall be called before any
business is proceeded with
(b) Reading and conformation of minutes of previous Annual Meeting
and of Special General Meetings (if any) held during the year
(c) Consideration of the Management Committees Annual Report,
Balance Sheet and Auditors Report.
(d) Election of Officers and Auditor by ballot. The Returning
Officer and Scrutineers of such election shall be persons other than
members of the Executive and Delegates.
(e) Determination of Captation Fee (Annual Subscription Fee) for the
ensuing year
(f) Determination of out of pocket expenses
(g) Business of which due notice has been given
(h) Any business which the meeting by a majority agrees to deal with
as general business.
27. Quorum at Annual and Special General Meetings
At every Annual or Special General Meeting ten (10) Officers and
Delegates shall form a Quorum. If a quorum is not present within 30
minutes of the appointed time of meeting, the meeting shall be
adjourned to such date, place and hour as may be determined by those
present.
28. Special General Meetings
A Special General Meeting of the Association may be called by the
President, or the Secretary when directed by a resolution of the
Management Committee, the Executive Committee, or on written
requisition from five (5) affiliated Clubs, and notice of the
meeting together with business to be transacted shall be forwarded
to each affiliated Club at least twenty one (21) days prior to such
meeting.
29. Ballot
The sense of any Annual, Special or Management Committee Meeting
shall be determined by a show of hands, unless a ballot be demanded
by not less than five (5) of those present. Where a ballot is held
for the election of Officers or members of Permanent Sub-Committees,
the details of the votes polled shall be disclosed to the meeting by
the Chairman or returning officer in order of preference, unless
such meeting decides otherwise.
30. Casting Vote of Chairman
At all meetings of the Association, Management Committee and
Executive, the Chairman shall have a casting, as well as a
deliberative vote.
31. Notice of Motion - Absence of Mover
In the absence of the intending mover of any motion, of which notice
has been duly given, the same may, with the consent of the meeting
be moved by any other member of the Management Committee.
PART VII – MISCELLANEOUS
32. Alteration of Rules and Rescission of Alteration
No existing Rule shall be repealed or altered, nor any new Rule be
adopted without the consent of two-thirds of those present and
voting at the duly convened meeting, annual or otherwise and of
which twenty-eight (28) days notice has been given to the Secretary,
and at least twenty-one (21) days notice shall have been of such
proposed repeal, alteration or adoption, by notice to all Officers
and to affiliated Clubs. No resolution passed by the Association
during the immediately preceding period of thirteen months shall be
rescinded without notice of motion having first been given.
33. Royal New South Wales Bowling Association
The Association shall be a District Association as defined in the
Constitution of the Royal New South Wales Bowling Association, but
may withdraw there from upon a resolution of the Association carried
by a two-thirds majority of those present and entitled to vote. At
least twenty one (21) days' notice by circular must be given to
Officers and affiliated Clubs, of any proposal to withdraw from the
Royal New South Wales Bowling Association.
34. Laws of The Game
The Laws of the Game shall be those adopted by Bowls Australia,
whilst affiliated with such organisation. Sec" Interpretations"
above
35. Funds - Management
(a) The funds of the Association shall be placed in such financial
institutions as the Management Committee may from time to time
determine to the credit of the South Coast District Bowling
Association
(b) Such funds to be operated on by the President,
Secretary/Treasurer and Assistant Secretary, or any two of them.
(c) The Management Committee shall have power to deal with moneys of
the Association not immediately required upon such securities and in
such manner as may from time to time be decided by the Management
Committee.
36. Audit
The Statement of Accounts and Balance Sheet for the period of twelve
months ending 30th June, duly certified as correct by the Auditor,
shall be submitted to the Annual Meeting, and shall be subsequently
dealt with as provide in Rule 26.
37. By-Laws
The Association shall have power to make and enforce Standing Orders
and By-Laws consistent with these Rules, the Laws of the Game and
Constitution of Royal New South Wales Bowling Association
38. Bowling Season
The bowling season shall commence on the first day of January in
each year.
39. Championship and Other Competitions
(a) The greens of all affiliated Clubs shall be made available to
the Association for the playing of any competition or match arranged
by and under the control of the Association. Not more than three
rinks in each seven.
(b) The Management Committee shall arrange Championship contests,
open to all members affiliated with the Association, and provide
trophies for winners and runners-up and may also arrange Pennant and
other contests and provide trophies therefor.
(c) Prizes in cash, must not exceed the maximum stipulated by the
Royal New South Wales Bowling Association
(d) The Pennants shall be played in two or more grades, numbered
numerically. In the event of a club entering more than one side in
one grade, such sides shall be designated alphabetically.
(e) The Match Committee shall carry into effect all instructions
from the Management Committee with such contests.
40. Rules of the Royal New South Wales Bowling Association
In respect to any matter arising for determination by this
Association not specifically provided for in these Rules the matter
shall be determined according to the Constitution of the Royal New
South Wales Bowling Association.
41. Club Tournaments
No Club shall conduct any tournament in which members of other Clubs
are allowed to compete, and pay entrance fees, without first
obtaining permission of the Management Committee, such permission to
be applied for in writing, accompanied by a programme of the
proposed tournament, and two months notice is required to be given
to the Management Committee thereto. Prizes, if in cash, must not
exceed the maximum stipulated in Rule 39(c).
42. Disputes and Objections
The Association shall have the power to settle all disputes on any
matter relating to bowling subject to the Conditions of Play as set
down by The Royal New South Wales Bowling Association
43. Disqualification
(a) The Match Committee shall have the power to prevent any Member
of an affiliated Club from playing in any match or competition, on a
representation in writing from the Secretary of the Club that he had
not paid his subscription to the Club for which he has declared to
play, or to any Club for which he formerly played, or (in the
opinion of the said Committee) for any other sufficient cause.
(b) No Member of an affiliated Club shall play in any Association
match or competition during the season for more than one Club
without a written permit from the Match Committee
issued in terms of Rule 7(a) and 4(a). All Major Club Championships
arc Association Competitions.
(c) A Club permitting a member to play in Association or other
fixtures, without having first duly entered his name for
registration as a member thereof by the Association and paid the
full capitation and other prescribed fees thereto, shall be liable
to such disqualification as the Match Committee may impose.
44. Pennant Travelling Fund
The Pennant Travelling Fund has been set up for the purpose of
subsidising Association Club sides involved in Zone 7 and/or Royal
New South Wales Bowling Association Pennant play-offs travelling
outside the South Coast District Bowling Association affiliated
Clubs. The funds shall be raised by entry fees on players as
determined by the Management Committee, payable immediately on
conclusion of the District Pennant season, and shall be invested in
a special account in such financial institutions as determined by
the Management Committee. Such account to be operated on as per Rule
35(a). Such funds shall be disbursed at the discretion of the
Executive.
45. Indemnity
The Officers of the Association and the members of any Committee or
Sub-Committee of the Association, duly appointed, acting in relation
to any of the affairs of the Association, and every of them, and
every of their Executors and Administrators, shall be indemnified
and held harmless by the Association from and against all actions,
costs, charges, losses, claims, demands and expenses which they or
any of them, their, or any of their Executors and Administrators
shall and may incur or sustain by or by reason of any act done.
concurred in, or omitted in or about the executions of their duty or
supposed duty in their respective Offices, except such (if any) as
he or they shall incur or sustain by or through his or their own
willful neglect or default respectively; and none of them shall be
answerable for the acts or defaults of the other or others of them,
or for their respective offices, or in relation thereto, except the
same shall happen through his or their own willful neglect or
default respectively.
46. Appointment of Proxies
No member shall attend or vote at any meeting of the association or
of any committee of the association or vote at any election of the
club as a proxy of another person if proxy voting is not allowed.
47. Funds - Source
(a) The funds of the association shall be derived from entrance fees
and annual subscriptions of members, donations and, subject to any
resolution passed by the association in general meeting, such other
sources as the committee determines.
(b) All money received by the association shall be deposited as soon
as practicable and without deduction to the credit of the
association's bank account
(c) The association shall, as soon as practicable after receiving
any money, issue an appropriate receipt
48. Common Seal
(a) The common seal of the association shall be kept in the custody
of the public officer.
(b) The common seal shall not be affixed to any instrument except by
the authority of the committee and the affixing of the common seal
shall be attested by the signatures cither of two members of the
committee or one member of the committee and of the public officer
or secretary.
49. Custody of Books Etc.
Except as otherwise provided by these rules, the public officer
shall keep in his or her custody or under his or her control all
records, books and other documents relating to the association.
50. Inspection of Books Etc.
The records, books and other documents of the association shall be
open to inspection, free of charge, by a member of the association
at any reasonable hour.
